Four Steps to Take So You Win Your Lemon Law Case

There are four things that every car owner should do if they are trying to win a lemon law case.  The first item concerns the paperwork trail.  The owner of the vehicle has a huge responsibility in regards to record-keeping.  In order for any case to be successful, it is imperative that the repair records be meticulous and detailed.  Keep a cover sheet that shows all the repairs that were done for the car, summarizing with date, place of service, description of problem, details of repair, hours of labor, cost of labor, cost of parts, sales tax and total of repair bill.  Keep with the cover sheet your original receipts and estimates and repair orders, plus copies of each.

The second item requires knowledge of the lemon Law statutes in your state.  Every state spells out how many repairs are required before the case may be brought to court.  Be sure you have the minimum number of repairs completed within the time frame of the statutes.  There is no time to dillydally on these repairs.  Get them done as quickly as possible, and be sure you have complete records of the repairs.

The third item also involves knowledge of the lemon Law statutes of your state.  You must be sure that your vehicle is able to be covered by the lemon laws in your state.  If it is a used car, does your state lemon law cover used cars?  If so, what kind of warranty must your car have in order for you to enact the lemon law, and do you have that warranty?  Is it a leased car, and does your state lemon laws cover that situation? Fortunately for some citizens, such as in Arizona, AZ lemon law statutes do cover leased vehicles. whatever type of item you are trying to seek protection for under your state lemon law, you must be certain that the statutes cover your RV, motorcycle, SUV, truck, van or other large consumer item, such as a computer.

The fourth thing every consumer must do to win a lemon law case is to be persistent.  Be prepared to push everyone.  You might have to push your car mechanic to schedule your appointments more quickly.  You might have to push your attorney as well.  And push yourself to keep track of all the details necessary for keeping complete records of your repairs and every effort that you are making to get your car repaired in a timely manner.

Time is of the essence in every lemon law case.  You have a time period in which to complete repairs.  You have a time period in which to file and get the consumer protection you deserve.  Don’t risk your successful lemon law case due to negligence on your own part.
